Current Context: The Consumer Protection Act, 2019 has successfully approved and implemented in India to protect, conserve and enhance rights of Indian consumers.
- The Consumer Protection Act, 2019 has replaced the Consumer Protection Act, 1986.
- In the new Consumer Protection Act is introduced to grant protection to the consumers including from traditional sellers to the new e-commerce retailers and platforms.
- The norms, rules, considerations in the act was briefed by Union Minister of Consumers Affairs, Food and Public Distribution Ram Vilas Paswan via video conference to the media.
- The act provides strict rules and norms for e-commerce business platforms in order to avoid cheat business and to maintain the trust of consumers on e-commerce.
- Features in Consumer Protection Act, 2019: Consumer protection Councils, Consumer disputes redressal commissions, Mediation, Product Liability, and Punishment for the manufacturers or the seller under the crime of adulteration of items.
- There will no fee charged to file the case up to Rs 5 lakhs as per the Consumer disputes redressal commissions rules and norms.
- The manufacturer or the seller will be punished for 6 months jail or a fine amount of up to Rs 1 lakh will be sanctioned if the consumer suffers an injury in the form of health, wealth after purchasing and utilizing the product. And in case of death of the consumer, the manufacturer and the seller will have to face 7 years of jail and fine of Rs 10 lakh.
- The act also proposes Central Consumer Protection Authority (CCPA) which will conduct the investigation process if consumer rights are violated. Thus CCPA will maintain rights and will protect the consumer.
