Current Context: The Ministry of Environment, Forest and Climate Change (MoEFCC) notified the Solid Waste Management Rules, 2026 on January 28, 2026, under the Environment (Protection) Act, 1986, effective from April 1, 2026.

  • These rules replace the 2016 framework and shift focus from waste disposal to a Circular Economy model emphasizing resource recovery.
  • For the first time, four-stream segregation at source is mandatory: wet, dry, sanitary, and special care waste.
  • Bulk Waste Generators (BWGs)—large societies, malls, universities—must process wet waste on-site or obtain an Extended BWG Responsibility Certificate.
  • The rules introduce “Polluter Pays” principle with environmental compensation and landfill penalties, reserving landfills only for inert/non-recoverable waste.
  • They also mandate Refuse Derived Fuel (RDF) use in industries (cement plants, WtE facilities), scaling substitution from 5% to 15% in six years, with special provisions for hilly areas and islands.
